Throughout these Terms, "Grief Gifts", "we", "us" and "our" refer to Grief Gifts Australia.

Our website provides information about our products and allows customers to purchase gifts, keepsakes and other products online.

Some of our products are handmade, naturally occurring or individually selected. As a result, there may be minor variations in colour, shape, texture, finish or appearance between individual products.

Where a product description states that an item is selected at random or that individual variations may occur, you acknowledge that the item you receive may differ slightly from photographs shown on our website.

These variations do not constitute a fault where the product remains consistent with its description.

4. Product Availability

We do our best to keep product availability and stock information up to date.

Occasionally, an item may become unavailable after an order has been placed. If this occurs, we will contact you as soon as reasonably possible to discuss the available options.

We reserve the right to discontinue products or change product offerings at any time.

5. Prices

All prices displayed on our website are in Australian dollars (AUD) and include GST where applicable.

Prices may change from time to time. Any price change will not affect an order that has already been accepted and paid for, except where required to correct an obvious pricing or listing error.

If an obvious error in pricing or product information occurs, we will contact you before processing the order where reasonably possible.

6. Placing an Order

When you place an order through our website, you are making an offer to purchase the selected products.

Your order is subject to acceptance and availability.

Once your payment has been successfully processed, we will generally send an order confirmation to the email address provided at checkout.

We reserve the right to cancel an order in limited circumstances, including where:

• a product is unavailable
• there has been an obvious error in the product description or price

If we cancel an order after payment has been received, we will provide a refund of the amount paid for the cancelled order.

• recipient details
• personalised information
• handwritten card messages.

We are not responsible for delays, failed deliveries or additional costs resulting from incorrect or incomplete information supplied by you.

8. Handwritten Messages

Many Grief Gifts orders include a complimentary handwritten card.

Where you provide a personal message, we will reproduce the message as supplied by you.

Please carefully check your message before submitting your order.

Grief Gifts is not responsible for spelling, grammar, names, dates or other errors contained in the message supplied by the customer.

If we make an error when reproducing the message you supplied, please contact us and we will work with you to rectify the issue.

Because handwritten cards are prepared specifically for individual orders, a change of mind about the message does not entitle you to a refund or replacement.

9. Personalised and Customised Products

Some Grief Gifts products may be personalised or customised specifically for your order.

Once a personalised or customised product has been prepared, we cannot accept returns or exchanges due to change of mind.

This does not affect your rights under the Australian Consumer Law if a product is faulty, incorrectly personalised due to an error on our part, or otherwise does not meet an applicable consumer guarantee.

10. Gift Purchases

Our products are often purchased as gifts for another person.

When purchasing a gift, you are responsible for selecting a product that is suitable for the intended recipient.

A change in circumstances, change of recipient, change in relationship or the recipient no longer wanting or requiring the gift does not constitute a product fault or create an entitlement to a change-of-mind refund.

Our Returns & Refunds Policy applies to all gift purchases.

11. Returns and Refunds

Our Returns & Refunds Policy forms part of these Terms of Service.

We do not offer returns, exchanges or refunds for change of mind, subject to your rights under the Australian Consumer Law.

This includes circumstances where:

• you no longer require the gift
• you have purchased the wrong product
• the recipient no longer wants the gift
• the intended recipient has changed
• you have misunderstood the nature or suitability of the gift
• circumstances surrounding the gift have changed after purchase.

Some Grief Gifts products contain handwritten messages, personal items, clothing, jewellery and consumable products such as tea and chocolate. These products cannot be returned simply because of a change of mind.

12. Australian Consumer Law

Nothing in these Terms of Service is intended to exclude, restrict or modify any rights or remedies you may have under the Australian Consumer Law or other applicable laws that cannot lawfully be excluded, restricted or modified.

Our products come with consumer guarantees that cannot be excluded under Australian Consumer Law.

Where a product does not meet an applicable consumer guarantee, you may be entitled to a repair, replacement, refund or other remedy depending on the circumstances.

13. Damaged, Faulty or Incorrect Products

If you receive a product that is damaged, faulty or materially different from what you ordered, please contact us as soon as reasonably possible.

14. Shipping and Delivery

Our Shipping Policy provides information about delivery methods, estimated delivery timeframes and shipping costs.

Delivery timeframes are estimates only and may be affected by circumstances outside our reasonable control, including postal delays, courier delays, weather, natural disasters or other events affecting transport networks.

Once an order has been dispatched, delivery is generally the responsibility of the relevant postal or courier service. However, this does not limit your rights under Australian Consumer Law where we remain responsible for a problem with the supply of the product.

Please ensure the delivery address supplied at checkout is correct.

All content on the Grief Gifts website, including text, photographs, graphics, logos, product descriptions, branding, designs and other material, is owned by or licensed to Grief Gifts unless otherwise stated.
